An offer is a clear and definite proposal made by one party (the offeror) to another party
(the offeree) indicating a willingness to enter into a contract on certain terms. An offer is
made with the intention that it will become binding as soon as the offeree accepts it.
Jane tells Tom, "I will sell you my book for $10.
Jane's offer is specific—selling a book.
The price is clearly stated—$10.
Jane intends for Tom to buy the book if he agrees to the price.
In this example, Jane is the offeror, and Tom is the offeree (the one who can accept or reject
the offer). If Tom says, "Yes, I will buy your book for $10," he accepts the offer, and they
have a binding contract.
